Health Insurance Dispute for Air Ambulance

OUTCOME: The insurance company reversed its denial of a claim and paid for the air transport of a severely ill child from Mexico to Chicago.

While on vacation in Mexico, a three-year old child became sick. Her parents took her to a local doctor who was unable to diagnose the sickness or alleviate the child's symptoms. Advised to evacuate ... the child from Mexico to a Children's hospital in Chicago by the child's pediatrician, the parents secured an air ambulance for the trip. They had to prepay for the transport. Their health insurance policy did cover emergency medical air transport. After arriving at the Children's hospital in Chicago, the child was properly diagnosed and administered the proper treatment to cure the illness. The illness turned out to be life-threatening and without the proper treatment, the child could have suffered significant bodily harm. The Children's hospital was also the leading health facility to treat the child's illness. The parents' insurance company, however, refused to pay for the air ambulance transport, claiming there was no emergency and the child could have been transferred to a different hospital. The family hired Neal Gainsberg to challenge the insurance company's decision to deny the claim.

On a warm night in Chicago, a tourist from Florida was enjoying her evening and walking in a popular area of restaurants and night life. As she walked by one establishment on a crowded sidewalk, she ... tripped on a hole in the sidewalk and broke her hip. She required immediate surgery at a local hospital. The business had blocked off parts of the sidewalk to use for its entrance, forcing pedestrians to walk near the hole. The City had also received complaints about the hole and other pedestrians tripping on the hole. The injured tourist hired Neal Gainsberg to collect damages against the business and the City.
