Joseph C Berger

Joseph C. Berger, a Principal in the Firm of Berger & Kernan, P.C., is a graduate of Fairfield University and Fordham School of Law. Mr. Berger has practiced for over 30 years as a trial attorney in the areas of Matrimonial Law, Employment Law, Corporate Law and Environmental Law. Mr. Berger is admitted to practice in the states of New York and Connecticut, as well as Federal Courts in New York, Connecticut and Vermont. He is also admitted to practice before the U.S. Supreme Court, where, in 2008, he and his colleagues obtained a 7 to 1 favorable ruling on an important case dealing with interpretation of the Age Discrimination in Employment Act. During his tenure as an in-house counsel at General Electric Company, Mr. Berger handled numerous labor arbitration cases. His publications include “A Manager’s Guide to Environmental Compliance ©.”In recent years, Mr. Berger has increasingly concentrated his practice in the area of Matrimonial Law. He has handled many complex litigations involving equitable distribution of marital property, maintenance and child custody. In dealing with extremely emotional issues, especially custody, Mr. Berger is guided by the principle that the best interests of the child must be the primary goal of all parties. Mr. Berger is mindful that litigation can be very expensive. Therefore, he strives to achieve settlements which are acceptable to the parties. However, when a trial becomes inevitable, his thirty years of experience in the courtroom is brought to bear in his clients’ service. Currently, Mr. Berger serves as an Alternative Dispute Resolution Arbitrator/Mediator for the United States District Court for the Northern District of New York. In addition, he is a member of the Board of Directors of the Saratoga County Bar Association.
