You need to postpone the wedding until the Court has signed a Judgment of divorce. Depending on when this was filed it could be a few months.

NYS' no-fault divorce law went into effect on October 12, 2010. It is not as simple as going to court, filling out paperwork and handing it in. ...

It depends on how long she has been in jail and how long she will be there. I suggest you consult with an attorney in your area.

No. You can file to vacate support and the reason being that the child moved out and his reasons were arbitrary and capricious.
