This was not a new DWI arrest. You came to me after having 3 prior DWI convictions. They were from 1999, 2001 and 2007. The Commissioner of Motor Vehicles (using the 25 year look back rule), had taken your license away and you were not able to get a new one. Someone at the DMV suggested you try and get one of your previous cases thrown out, and thus you would only then have prior 2 DWI convictions. I was very honest with you when we first spoke. I told you that I could do a 440.10 motion to the court to try and vacate one of the convictions, but I also told you it is very difficult to do and usually will not work. Even though I told you that it was a “gamble” to pay money to try and get one of these convictions vacated, you stated that you were willing to try. So you hired me. I worked on your case for over three years, without asking fcor any additional money. Unfortunately, the motion was denied. You then offered me more money to try something else, but I told you that I did not believe that I could do anything else and would not take any money to do something that would lead to another dead end. So you spoke to other lawyers until you found one that told you what you wanted to hear. I understand that you are upset that I was not able to perform a miracle here. I hope that the new lawyer you paid money to can get you what you are looking for, though I doubt it. I am sorry that you were upset with my honesty. I wish you only the best.
