Barnes v. Fleet National Bank, N.A.
Mar 05, 2007OUTCOME: Won appeal, settled for $12.5 million to the class
Consumers were given inaccurate and misleading notices of the dates when increases in fees and minimum balances would take effect by new bank when taking over former bank, causing widespread confusion ... among account holders. We sued under the federal Truth in Savings Act and the Massachusetts Consumer Protection Act and had to appeal to the First Circuit U.S. District Court of Appeals, where we won. The decision on appeal can be read at http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=1st&navby=case&no=031027&exact=1.
