Dismissed for lack of jurisdiction. Original Petition filed by Client, and amended petition filed by the attorney. "Digging" was requested by the attorney (to build the contact with Client's state), and it revealed that (although consisted of many outdated materials) proffered evidence was unable to prove that Respondent was ever in NY (and of course the judge and the respondent's attorney reviewed them all). There was no need to repeat what's in the papers during the final hearing. Notwithstanding her review above, Client fully acknowledged the risk of having this case dismissed due to the lack of jurisdiction. Our practical goal was to have the temporary order of protection extended as much. Courtesy refund was issued and accepted by Client PRIOR to posting this review, as the dismissal happened EARLIER than we expected. Earned hours had to be taken off to issue the refund. It is unfortunate that the respondent was out of state, and there was no contact with her state, but this should not be on the attorney. In fact, this matter would have been dismissed on the first returned date if Client didn't have an attorney. These are the facts. I hope she gets the supports she needs, and understands that she can ask the court for an intervention or call 911 whenever she feels the needs to.
