Plaintiff brought action seeking a money judgment of $2751.34 against defendant for recovery of no-fault medical benefits rendered to its assignor, plus statutory interest and attorney's fees. Insuranc ... e Law 5106, 11 NYCRR 65/15 (h)(1) and 65.17 (b)(6)(v). The services included MRIs of the cervical, thoracic and lumbar spine. Basedon the testimony and evidence admitted at trial, defendant has failed to show that the services herein were inconsistent with generally accepted medical/professional practices and would not further the diagnosis and treatment of [the assignor]. While defendant's expert (name omitted) testified that (the assignor) presented with no pain and therefore was not entitled to an MRI, plaintiff's expert witness (name omitted) found evidence of radiculopathy which indicates radiating pain. The MRIs were therefore medically necessary. Judgment for Plaintiff.

Plaintiff medical provider sought payment for physical therapy services provided to the assignor. Defendant insurance carrier denied plaintiff's claims on the basis of lack of medical necessity in that ... more physical therapy treatments would not benefit the plaintiff-insured. The Court found that Plaintiff-insured's treating doctors issued reports that indicate exactly what injuries were sustained and what treatments were provided. Plaintiff's expert medical doctor testified where chronic pain exists...it is good practice to prescribe physical therapy as opposed to medications that may have side affects or addictive qualities. He further concluded, based on the treating physicians' reports that physical therapy should have been continued. The Court agreed that the defendant did not meet its burden of proof for lack of medical necessity. Judgment for Plaintiff. Civil Court of the City of New York, County of Kings. 85114/2002.
