At the subsequent preliminary hearing, the DA attempted to bring in evidence regarding the two counts of attempted auto theft that had been found not true by a jury. Based on our objection, the preliminary hearing judge excluded the evidence of the two counts of auto theft and eventually found a lack of evidence on the auto theft charge.

He was charged with possession of marijuana for sale and ... his cash was seized with a forfeiture proceeding. We presented evidence to the District Attorney showing that we would be able to prove at trial that all the cash came from our client's legitimate business, that he had a valid medical marijuana recommendation at the time of the traffic stop, and that the amount of marijuana in his possession at the time of the stop was within the recommended amount. The District Attorney agreed, dismissed all charges, and agreed to refund all the cash seized.
