The only thing I can agree with Anthony about is that ours was a painful experience. Representation of clients in matrimonial matters takes more than just legal acumen. There is also a delicate attorney-client relationship that must factor in the client’s high emotion and anxiety while forging a bond of trust. Unfortunately, this particular relationship also included the additional challenges of a client who evidenced increasing behaviors of having issues with memory and recall, and who more often than not forgot entire conversations and meetings we previously had, like the numerous explanations to him of exactly what a pendente lite application was and the negative ramifications one would be to him. This was only exacerbated by his penchant to withhold pertinent information from me, which would backfire when I was ambushed with the information during Court appearances, and his flat refusal to acknowledge that his spouse was legally entitled to equitably share in marital assets acquired during the marriage, and not just what he thought was “deserved.” It became increasingly more and more difficult to represent a client who fell asleep during Court appearances and even during his own deposition, and who spent hours upon hours at my office “reviewing” his file over and over again. It was especially difficult to navigate the growing minefield of challenges with a client who either could not accurately recall, or deliberately ignored, legal advice given to him, time and again. Naturally, this untenable relationship eroded and eventually our attorney–client relationship ended, which was a relief to me. At no time did I overcharge Anthony in legal fees and, in fact, did not bill him for many of the repeated conversations had between us when he had forgotten them. To that point, he appears to have forgotten the accurate amount of total legal fees he incurred with my office, as that figure was nowhere near the exorbitant $40,000.00 he “remembers” he was charged. Sadly, since being discharged in 2016 (over two years before Anthony posted his review), I have learned that Anthony has hired and fired a number of other attorneys, and is now representing himself, pro-se. I am not in the least surprised to find that the matter is still unresolved, years later, as without first addressing the obvious underlying communication and memory problems, there cannot be a realistic final resolution. However, I remain compassionate for this former client who is clearly still contending with the same underlying issues of which he was blissfully unaware then and now, despite the necessity of the parting of our ways. It is truly unfortunate that sometimes, despite an attorney’s best efforts, you simply cannot prevent a client’s self-destructive behavior no matter how hard you try.
