The main piece of information that you left out is how much debt do you have that you want to get rid of.

It depends on the lender. There is no reason why you should not be able to get the loan; understand that it will not be discharged in bankruptcy,

The trustee is looking for assets of yours that may be hiding in the bank accounts of your spouse, nothing more.
