John W. Mitchell, Esq. is a litigator with extensive experience in both state and federal civil and criminal litigation, appeals and post-conviction proceedings. He holds an "AV Preeminent 5.0 Peer Review Rating" from Martindale Hubbell. He is widely respected by both the bench and the bar. Although his practice is mostly in the State of New York, he has been admitted pro hac vice in cases throughout the United States. He has served as a lecturer and author for Continuing Legal Education classes for the Practicing Law Institute and The New York State Association of Criminal Defense Lawyers.
As the Court recently observed in Cont'l Cas. Co. v. Caramadre, 2020 U.S. Dist. LEXIS 20661 (D.R.I. 2020): "Attorney Mitchell practices law primarily in New York. A seasoned litigator, he has focused on and excelled at civil and criminal litigation at the trial and appellate levels. Attorney Mitchell submitted persuasive declarations from three attorneys who practice outside of Rhode Island, have worked with him as co-counsel in several cases and averred to the high quality of his work. Attorney Mitchell’s rate is reasonable by standards for a senior litigation lawyer serving as lead counsel in a complex civil case."

John Mitchell is a great listener and can diagnose the legal issue, and make understandable to the lay person. . He is very experienced, and highly knowledgeable. He then goes on to run the traps and explain clearly the strategy that needs to be implemented. He guided us in a 2255 and refined the...

John Mitchell is an unique combination of superlative legal skills, unassailable integrity and thorough, caring decency. Having been let down (a euphemism for dishonest, callous and shoddy professional behaviour) by a series of lawyers the serendipitous happenstance of coming across him was all...

Excellent lawyer, John W. Mitchell Never quit for my freedom and that is why you hire a lawyer especially when you are facing a long prison term. He never let me down even when it was the worst of situations and I was a very hard and angry client to deal with. He gave me his best and actually cared a...
"Attorney Mitchell is without question the hardest working, intelligent and able litigator I have had the pleasure of working with. His veracity in the courtroom and his tireless work ethic ensures that everyone of his clients is provided with the best legal representation available. The caliber of John's representation is second to none and all those who retain Attorney Mitchell can sleep easy knowing they have "The Best" in their corner."
"I endorse this lawyer. John has one of the most facile legal minds in the business. He is extremely hard working, and as one Federal District Court Judge we tried a case to a not guilty result told me, is "scary smart.""
"I had the privilege of working with John as pro hac vice counsel on a 1st Cir. Fed. Ct. case that went to trial in October of 2014. John worked endless hours on the case. His brilliant writing and superb advocacy secured a verdict on not guilty on all counts. I can't speak highly enough of John, his skills are unmatched!"
"I strongly endorse John W. Mitchell as a truly outstanding criminal defense with special expertise in all forms of post-conviction relief."
