I first met David at about 10 pm on holiday after spending almost 22 hours in jail accused of driving while intoxicated. Unknown to me at the time, my husband had hired David earlier that day after receiving a recommendation from our family attorney. Without hesitation, David accepted the case and c...ame to criminal court in Manhattan to defend me on that holiday night. I have never been in a criminal court room, much less a defendant in a criminal proceeding, and I was scared and clueless as to what was going on. All I did know was that I had been up for over 24 hours, without a shower and sitting next to people charged with much more serious crimes than me. David handled the arraignment flawlessly. Because I had a high “blow”, the ADA was only offering a misdemeanor, 2 days of community service, a 6 month suspended license and an ignition interlock device on my car. That night David rejected their offer and afterwards explained the strategy he would use to convince the ADA that a misdemeanor was an excessive plea given my age, (read: Mature lady) and the fact that I have never been involved in a criminal proceeding. Well, it took several months, 2 postponements and calls to the ADA, her supervisor, and the lead ADA for both misdemeanors and felonies to get them to re-consider their offer. This was the hard, behind the scenes work that David did for me! Of course, there was no guarantee that David would be successful, but I felt very comfortable that David had the experience and the ability to argue for a reduced offense. In the end, David was successful, the charge was reduced to a violation, I had my license suspended for just 90 days and the community service was eliminated from my plea. I could not be happier with the work that David did for me. He is great guy that was fully engaged on my behalf with extensive court room experience, (he was also an ADA in the Bronx for many years). David has a keen mind and a friendly person.

I went anyway and also passed everyone of their random drug tests. Which likely helped later down when I finally had to appear in court, ~6-7mo (yes, everything is a long, drawn out process).. Part 1: a DMV Judicial hearing to take my license away for a year. I had a 1%, chance, possibly less of loosening my license. David Kirsch, Esq. WON. Part 2: I still had Brooklyn/NY-State after me (aka the Brooklyn DA), Mr Kirsch managed to get me a "deal"/Plea-Bargain (a highly unusual one I've been told) where I just urinated (tested for drugs & alcohol) weekly for 6-9mo, continue to talk to my private "shrink" (who was to stay in touch with court system) & pay a few hundred $ in fines/fees. Because I never "screwed up", never missed appointments, was in a “rehab program” prior to the case (who once again found me “clean”), I was "released" after 6mo from a 6-9mo plea-bargain. Not to mention “all of this” will appear as a traffic violation (I was facing a FELONY due to A. this being my 2nd time & B. my license was suspended at the time for being lazy and not paying a minor traffic ticket). I wouldn't hesitate or think twice about hiring David J Kirsch, Esq., again for any legal matter. I will however think twice before getting behind the wheel of a car with anything other than diet coke in my system. Maybe I just got lucky? But having a hell of a good attorney doesn't hurt. FYI: No, I'm not related to Mr. Kirsch, I'm just/was a client. Oh, if it matters, his rates are "in-line" with all other attorneys/firms in NYC. It's cost me plenty of time, embarrassment, dignity, stress, etc. But, you can't put a price on excellence. I hope I never have to, but if I had to hire an attorney again, without a doubt, David Kirsch would be my "1 call" I get in jail. Words can't describe my thanks & praise for Mr. David J. Kirsch's time, effort, dedication & saving me from potential jail time & a year without a license.
