Greg Shatan’s practice focuses on intellectual property and technology transactions, web accessibility under the ADA, Internet and domain name law and policy, and trademark portfolio management, licensing, protection and enforcement.

IP/Technology Transactions. Greg regularly represents clients entering into sophisticated outsourcing agreements; software development, licensing, maintenance and support agreements; and cloud and website development and hosting agreements. He has also handled numerous licensing, endorsement, sponsorship, production, distribution, consulting, marketing, franchising and development agreements. Greg also works with clients on terms of use, privacy policies and social media policies.

Web Accessibility under the ADA. Greg helps companies navigate the legal, regulatory, business and technical landscape of “web accessibility” under the Americans with Disabilities Act: the obligation to make most websites and mobile applications accessible to individuals with vision, hearing, motor and cognitive disabilities. This includes internal audits, legal analysis and counseling, business planning, and compliance and training programs.

Internet and Domain Name Law and Policy. Greg’s practice includes a significant focus on Internet governance, domain name law and new media counseling and enforcement, including managing domain name portfolios and securing the transfer of domain names through acquisitions and Uniform Dispute Name Resolution Policy (UDRP) and other processes. He has counseled clients on matters relating to the new generic top-level domain (gTLD) program, including assisting clients with applications, the Trademark Clearinghouse, protection and enforcement and ICANN relationships. Greg regularly assists clients with online policing and enforcement of their IP rights, using a variety of methods to remove offending and infringing uses from the Internet. He also works with clients on online data privacy, data breach and cybersecurity matters. Greg is the President of the Intellectual Property Constituency (IPC) of ICANN, which represents the interests of IP creators, owners and distributors in the global multistakeholder governance of the domain name system.

Trademark Portfolio Management, Licensing, Protection and Enforcement. Greg represents clients on strategic brand management and IP portfolio management matters, including clearance, prosecution, maintenance and enforcement of trademark rights around the world. He has also represented several major musical artists in their trademark, licensing and endorsement activities, and in protecting and enforcing their trademark and publicity rights, particularly online.

IP/IT in Mergers & Acquisitions. Greg has worked on over 700 transactions, including both the sale and acquisition of intellectual property and technology rights and assets, as well as intellectual property and technology issues in mergers and acquisitions, restructurings, financings and other corporate transactions. In transactions, he works closely with clients on strategy, structure, drafting and negotiating purchase and merger agreements and ancillary agreements, such as assignments, licenses and transition services agreements. He also works on the due diligence and post-closing transition aspects of transactions.

Greg advises and works with clients in various industries, including media, entertainment, consumer goods, technology, internet, fashion, apparel, accessory, jewelry, fragrance, financial services and publishing.
