Michelle Star Babbitt

As a parent who has recently interacted with the Office of Administrative Trials and Hearings (OATH), I am writing to express my deep concern about the fairness, accessibility, and human impact of IHO Babbitt—particularly as they relate to families and children regarding this IHO. She was condescendi...ng to everybody involved. I was at a hearing for my child who had severe autism and she just didn’t care. I left the hearing feeling very sad for my child. This IHO is awful.

Babbitt has repeatedly demonstrated a troubling disregard for the principles of impartiality and due process. Her conduct is marred by erratic rulings, inconsistent application of the law, and a tendency to let personal bias cloud judicial discretion. Rather than upholding the law with fairness and... integrity, Babbitt often appears more interested in asserting authority than in delivering justice. Even more concerning is Babbitt’s apparent indifference to precedent and legal reasoning. Her opinions lack the analytical rigor expected of someone in such a critical position, often substituting bluster for substance. In doing so, Babbitt not only undermines the credibility of OATH but also erodes public confidence in the legal system as a whole. For the sake of the legal community and those who rely on the system for justice, it is imperative that Babbitt either reform her approach—or reconsider her position entirely.
