Withdrew from case 7 days before trial, missed every deadline, refused to refund my money

Mr. Gilbert agreed to litigate my case for a Flat Fee of $4,500.00. I paid him his fee upfront. I am on a fixed income from Social Security. Approximately sixty days went by and I had sent the same email five times over 60 days asking for a receipt, a fee agreement letter, specific questions about e...vidence and discovery. Mr. Gilbert kept avoiding answering this particular email. He then withdrew from the case, having NOT submitted to myself, the opposition or the court a single memo, motion, document or letter. He missed all the deadlines for submitting discovery, did not subpoena a single witness and when I pointed out he had not prepared a strategy or notarized a single document for my counterclaim, he panicked. He then sent three emails to an incorrect email address requesting more money claiming the scope of the case had changed claimed he couldn't reach me despite receiving other emails from me and never bothered to send a certified letter informing me he was going to withdraw. Mr. Gilbert failed to complete even 30% of the work required, did not submit a single document and refused to refund half of the Flat Fee I paid him upfront. The flat fee was to litigate the case and get it dismissed and present my counterclaim. He missed all the deadlines and kept all my money and withdrew 7 days prior to trial . This case is now going to fee arbitration and a complaint has been sent to the ABA. . To this date I still have never received a receipt. A motion for sanctions has been submitted.

I am sorry that you are not satisfied with the way my firm handled your case. I strive to represent my client with sound and fair legal advice. In your situation, I put in numerous hours of work on your case. There was a favorable settlement opportunity that was fair. Your insistence to litigate was based on your animosity against the Co-op Board. Ethically and professionally, I could not condone using this case for such a vile vengeance.

Very thorough and reasonable

Mr. Gilbert represented my company in case brought by a disgruntled employee. He claimed we owed him over $100,000 unpaid wages. Even we don’t speak perfect English, Kenny was very patience in explaining to us of all the options. He always answered or returned phone calls. He gave us update on the ...progress and made sure we understand what was going on. At the end, we were able to settle the case with less than $15,000 without dragging out for a long time. I can’t tell you how relieved we felt. I highly recommend him!

A thoughtful, honest and very careful lawyer.
