That sounds very difficult, but I do not see it as a valuable claim for you. I am sorry you had to experience that though.
Why not simply sue for the sum you are owed?
It sounds like you only received a violation and it was dismissed, so no you would not have a criminal record.
I would recommend she contact unemployment about it and be honest.
Whatever the internal rules of the parent company are will determine if they think this is okay or not.
I don't see a valuable claim against the employer coming from this.
I would suggest simply filing in small claims court.
