When he later filed Chapter 7 bankruptcy, the bank commenced an adversary proceeding in the United States Bankruptcy Court for the Southern District Of Florida. Scott Lanin conducted a trial and successfully defeated the debtor’s homestead exemption, blocked his discharge based on his dishonest and fraudulent conduct, and helped the bank recover its loan.

The lender agreed to remove the lis pendens and discontinue the foreclosure action. Out clients had suffered a financial hardship when the husband lost his job. The modified outstanding balance on the mortgage, including interest and the escrow shortage and other charges was approximately $934,715.23. The amount to be capitalized was $123,671.78. The lender waived late fees and any delinquent interest in the amount of $173,927.40. The interest rate was reduced to 3.8750% with a step-up after 60 payments. Our clients can now sleep a little easier at night knowing that they can now afford to pay their mortgage and keep their home.

We help a married couple obtain a loan modification and save their home on Staten Island. As a result of our efforts, a foreclosure action in the Richmond County Supreme Court was stopped. The lender ... (Ocwen) agreed to remove the lis pendens and discontinue the foreclosure action. The couple could not afford to make their monthly mortgage payments due to unexpected increased household expenses caused by a death in the family and illness. The lender agreed to a trial mortgage loan modification which reduced their monthly mortgage payments down to $764.27 from $1,369.00. Our clients were $182,868.49 in arrears. Their lender then agreed to a permanent HAMP loan modification agreement that waives all late charges on the arrears. The principal balance is now $182,865.65 with a fixed interest rate of 4.000%. The total monthly payments are now $1,377.84 including escrow payments.
