You could bring an action under Article81 to have you appointed his guardian. It might be opposed by hs wife, but you could do your bet. Hood luck.

Generally the Guardianship order will supersed the power of attorney. The court has the right to do this under the statute.

You can apply for a guardianship to the State Supreme Court. She could oppose it. As her child you have priority under the statue.
