Brian J Markowitz

I am a Partner at Tarter Krinsky LLP, and focus my practice on complex commercial litigation, construction disputes, real estate litigation and construction contract drafting and negotiation. I generally represent property owners, developers, construction managers, general contractors and design professionals in all phases of litigation, from case inception through trial or alternative dispute resolution, and, when necessary, at the appellate level. I am admitted to practice law in the States of New York and New Jersey and the United States District Court, District of New Jersey as well as the Southern and Eastern Districts of New York.

My experience includes litigating mechanics' lien foreclosures, delay claims, extra work disputes, defaults and wrongful termination claims, trust fund claims, surety and insurance issues, design defect claims, contested mortgage foreclosures, adverse possession claims, license agreements, and coop/condo disputes. I have extensive experience in all aspects of contract drafting, negotiation and review, including the drafting, negotiation and review of construction management and general construction agreements, architectural and engineering agreements, construction access and license agreements, consulting agreements and subcontracts.

I have been selected by Super Lawyers Magazine as a Rising Star in Construction in New York City, an honor given to less than 2.5% of attorneys in the state. I am the drafter of New York Lien Law Section 44-b, dealing with necessary parties to a public improvement mechanic's lien foreclosure action.

I serve on the Council of Phi Delta Phi International Legal Honor Society. Additionally, I have volunteered to assist victims of the September 11 attacks in applying to the Victims Compensation (Zadroga) Fund and have worked with victims of human trafficking to expunge their criminal records resulting from having been trafficked. I am also active in the New Jersey Chapter of the Leukemia and Lymphoma Society.

I received my Juris Doctor from Brooklyn Law School and graduated from the State University of New York at Oneonta, with a Bachelor of Arts degree in Political Science.
