The host car clipped the right rear of the trailer, and veered right, where it struck and became wedged under another tractor trailer, essentially tearing off the roof of the car. Client was crossing a city street in broad daylight. He did not use the crosswalk, but rather crossed mid-block. Before crossing, he saw a car coming from his left more than a football field away and ... knew that he had time to cross the 12 foot wide southbound lane of travel. Before he reached the center line of the roadway, he was struck by the car. The impact fractured his left lower leg and left shoulder. He required surgery to place a rod in his left tibia that was secured by screws. He underwent a partial left shoulder replacement because the doctor could not fix the shoulder fractures. We were able to prove that the driver was speeding based on how far away he was when the client first saw him, and how long it took the client to walk the nine feet before he was struck. Also, in a 25mph zone, there was no reason that had the driver been paying attention, he would not have been able to see the client crossing the street and slowed down to allow him to do so. The jury determined that the accident was 100% the fault of the driver. Although the client missed six months of work,no economic claim (wage loss) was made as he had collected disability payments.
