Breach of Fiduciary Duty - Estate Value Plummeted while in her Care

Suzanne is the executor to my family estate assigned by the court. There was a property valued at date of death in the amount of 335,000.00. She failed to maintain the property, dismissing the caretaker. She got approval from the court to sell the property for 94,086.12, a 240,913.88 loss. The... argument was that the price was adjusted because of the deterioration and damages from the trees, to justify the lower price. The sale was approved. In addition, she handed over 15,851.02 of insurance proceeds to the buyers for the damages to the property. That money should have remained in the estate in addition to the sales price to at least partially compensate for the loss in value. The buyers already got the distressed price on the property. The contents of the property in the houses were no longer part of the Estate but held until she approved the removal plan. She did not maintain insurance on the contents. The contents were lost with no compensation to the owner. As executor she was entrusted to maintain the value of all the estate assets. She failed to do so. In my opinion, she failed to perform up to the standard of the role as executor.

Thank you for reading my comment. Breach of fiduciary duty is a really strong allegation, but not surprising coming from the individual who wrote it. I have not commented publicly on this until now because this estate is just being finally settled. The individual who wrote this negative review was not a probate client but the beneficiary of an estate of which I was the court appointed administrator. I will refer to the individual as he because I believe him to be the brother and one of 2 executors, the decedent's children, who were embroiled in litigation against each other. One beneficiary, I believe the sister, petitioned the court to have an independent administrator appointed and the other was removed; I was then appointed by the court. These beneficiaries eroded the estate via litigation over a 7 year period between 2007 and 2014. I was not a party to this litigation. When the litigation was settled and there were virtually no assets left, these beneficiaries began to manufacture claims against me. They did not prevail in any of these claims as court records delineate. Estate litigation cases are as emotionally fraught as divorce and these beneficiaries were angry at each other and then at the attorneys. I contacted the local police twice during the period of this case due to threats that were made. Suzanne M. Kourlesis
