I am concerned that it might be a conflict. Maybe your attorney can consider alternatives such as innocent spouse relief.

Just get a professional tax preparer to look at you 1040 and prepare and file your NJ GIT. I do not trust what the preparer has done.

The entire rent would be included my the expenses such as taxes, insurance and repairs. You do not get a deduction for the rent you pay.

Usually, the form is required for >$100k gift per year from a Non-US Citizen. If this is part of a plan of gift-giving it may need to be reported....
