Frustrating and disasterous experience

When I went to see him the first time, he sounded as if he has been handling discrimination cases for years. 7 months and a few thousand dollars after I provided him with information, sorted out what needs to be done (because he doesn’t want to pay for assistant) nothing was done. He was supposed to ...get paid for filing and deposition, etc. When I finally realized that he didn’t do anything and asked him to refund me and for my file, he then told me that he asked and was told that legally, I should’ve gone through other venues before I seek a lawyer. Either he deliberately kept asking for money because he’s a con or he doesn’t know the law; either way, he is not someone you want anywhere near your case. To top it off, he told me that he KNOWS that he owes me, that he didn’t do anything but he “can’t afford to repay me” therefore, he will do something for me, like if I wanted to start a non for profit or fill out some forms “a few thousand dollars worth of forms?” rather than give me back what he owes me. Not only that he didn’t pay me back, sespite many calls and requests, he absolutely refuses to give me back my file. He promissed me many times that he'll be there and give them to me, and when I go to the appointment, he either is not there, or he simply tells me that he didn't get a chance to get the BOX from storage! They are not heavy, it's a few papers, what box. Stay far, far away from him. He is an embarrassment to his profession.

Document Scan: First and foremost each client is asked to provide a copy of their documents. The reason for this is that in a consultation when there are hundreds of pages to be reviewed the client does not pay for the consultation but is held responsible for the cost of copying the documents. This client provided document copies and they were returned to her. It is recommended that all client documents be scanned. The Frivolous Lawsuit: It is important to recognize that not every circumstance in which a client feels he or she is wronged will result in a lawsuit. At times failure to provide pertinent documents to proceed with a complaint would require an attorney not to proceed with the case to avoid the frivolous lawsuit. This occurs in cases when the client is determined, by hook or by crook, to sue someone and changes the terms of the Retainer Agreement before the complaint is filed. The frivolous lawsuit requires both client and attorney to pay the defendant's attorney's fees and costs. That was avoided in this case.

Admonition issued in NJ, 2000

updated on 03/25/2016

An admonition means an attorney did something wrong but may still practice law. The Bar gives the lawyer an admonition in hopes that he or she will not repeat the behavior.

Michael’s comment:

“15 years ago the law office was closed due to a disability. Of the many cases handled at the time one clients alleged he did not receive his file. He filed a grievance and the matter was resolved by providing him with another copy.”
