In New Jersey do you have to pay inheritance / estate tax if the estate is insolvent?
Something doesn't sound right to me - with it being an insolvent estate it should have yielded zip.

Probate is the act of getting authority to act for a dead person.
If you get benefits at 62 you'll get about 30% less than if you did at your full retirement age

If the trustee is causing waste or not performing their duty you can bring an action and ultimately seek removal

I'd look for another attorney. You can hold back funds in reserve and make partial distributions.
For nj and most states you need 1 day in the state to establish residency. She is presently PA so that is where you'd seek medicaid.
