I was assaulted by a lunatic “Karen” coming off of an NJ transit train and was forced to act in self-defense. Though the incident was captured on video via the train station camera and a statement from the train conductors corroborating what I explained happened, we were both given a citation for di...sorderly conduct. When we went to the first court hearing, I declared that I wanted to press assault charges, and then my attacker decided to do the same claiming that she was the victim and I was the aggressor. Per the presiding judge in Garfield, I sought legal counsel and came across Mr. Garcia. The case dragged out for 10 months thanks to the delay tactics of my assaulter. Even though there were statements and video capturing the incident that showed her as the aggressor, my assaulter refused to be cooperative and instead was very combative with her attorneys (she went through 2 different public defenders), the judge, the court prosecutor, and of course Mr. Garcia. She refused to listen to reason and would cause a scene each time we had to appear at court. It wasn’t until Mr. Garcia was able to subpoena and present 3 different witnesses into our final court hearing that my assaulter decided to rescind her claim and hoped to mutually dismiss the charges. I still wanted to pursue charges against my attacker, but because we both were technically issued a citation for disorderly conduct, Mr. Garcia cautioned that the optics would not present well to the judge if there is an opportunity for the case to be dismissed instead of proceeding with a trial which could agitate the judge in having to deal with my lunatic attacker. Because I had way more to lose than my attacker did, I yielded to Mr. Garcia’s wise counsel and agreed to mutually dismiss the charges against ourselves. Though I wanted to so bad for my attacker to be punished for assaulting me, Mr. Garcia was relentless in ensuring that I was safe and did not jeopardize myself in a way that could have possibly resulted in a criminal record. When you have the court appointed attorneys pulling aside Mr. Garcia and expressing how impressed they are and have never seen anyone successfully secure 3 witnesses in their 13+ years of litigating, that right there should tell you of the high caliber Mr. Garcia is. I hope I’m never in a position to be represented by Mr. Garcia again, but if I do, Mr. Garcia is the first and only person I would have represent me!
