Patrick James Mulqueen

Patrick J. Mulqueen, an associate in the firm's Global Insurance Services Practice Group, is an experienced and effective litigator who concentrates his practice on insurance coverage litigation, bad faith disputes, and coverage counseling. Patrick has advised and represented insurance industry clients on a wide range of coverage matters involving commercial general liability, professional liability, commercial property, directors and officers liability, excess and umbrella, homeowners, municipal and law enforcement liability, commercial auto, and employment practices liability policies.

Patrick has a wealth of experience handling complex insurance cases in state and federal trial and appellate courts, including declaratory judgment actions, breach of contract claims, claims for extra-contractual liability, and rescission and reformation claims. He has served as coverage counsel to numerous primary and excess insurers, and has monitored coverage and liability issues in high-exposure cases.

Patrick is a frequent contributor to Goldberg Segalla’s insurance blog, The Insurance & Reinsurance Report, as well as to the firm’s Timely Notice podcast. He is highly regarded among his colleagues, and has been recognized by Martindale-Hubbell with an AV Preeminent rating.

While pursuing his juris doctor at the Brooklyn Law School, Patrick served as an associate managing editor of The Brooklyn Law Review. During his third year, he was selected for a prestigious clinical program at the U.S. Attorney’s Office for the Eastern District of New York, where he prosecuted misdemeanor and petty offenses in federal district court. After graduating cum laude, Patrick served as a law clerk to the Honorable Jerome M. St. John of the New Jersey Appellate Division.

Obtained summary judgment in the U.S. District Court for the District of New Jersey on behalf of a commercial property insurer in a lawsuit arising out of a Superstorm Sandy claim, based on the policyholders’ failure to present competent evidence to support their breach of contract claim against the insurer
Obtained summary judgment in the New Jersey Superior Court on behalf of a homeowners insurer in a third-party complaint seeking personal liability coverage for bodily injuries arising out of a bar fight, based on the policy’s assault and battery exclusion
Successfully argued and defended an appeal before the New Jersey Appellate Division affirming the trial court’s dismissal of a professional negligence complaint involving claims for lapsed Personal Injury Protection benefits under New Jersey’s "Deemer Statute"
Obtained summary judgment on behalf of a homeowners insurer in the New Jersey Superior Court in a first-party coverage dispute arising out of Superstorm Sandy, based on the absence of admissible expert opinion evidence regarding the valuation of the insured’s property damage
Successfully opposed a motion filed by a policyholder’s assignee to amend its complaint to assert a bad faith claim against a professional liability insurer in New Jersey federal court
Obtained summary judgment and a declaration that an umbrella insurer had no obligation to provide coverage for an award of fees and costs against the insured as sanction in an underlying personal injury suit
Successfully defended an appeal before the U.S. Court of Appeals for the Third Circuit affirming the dismissal of legal malpractice claims based on the plaintiffs’ failure to timely serve an affidavit of merit
