Yes, it is and the bank is not required to give you a loan modification. Further, if you are not behind in payments, they have no incentive to talk.

You should be okay to make the Motion to file out of time, due to excuseable neglect. Worst case is that you have to refile.

Arson can not be expunged from a records. Most JV offenses are sealed in NJ.
