I agree with Barbara. There may be contractual set-off rights if both accounts are with the same bank.

I don't see how unless you are in collections on a judgment. If you have a Court date it would seem you do not have a judgment yet. May be...

You have a contract with the bank. You have to see if there are bases for freezing the account in there.

The question comes down to cost/benefit. Can you sue? You can always sue. Would the recovery, if any, exceed the costs of suit. Unlikely.
