James T. Flaherty has been practicing law for over 40 years. He uses a team approach to solve the problems created by divorce, working with four talented attorneys and three experienced and hard-working paralegals. In his practice he deals with family law trials often involving large marital estates, complex custody issues, and post judgment enforcement issues. He also frequently receives referrals from other members of the family bar requesting that he try or co-chair their family cases in which there is little or no prospect of settlement.

Attorney Flaherty has been selected to Connecticut Super Lawyers in every year since 2009. He provides legal counsel in family law matters involving domestic violence, paternity, prenuptial and postnuptial agreements, gay and lesbian family law, father's rights, restraining orders, spousal support, child support, separation agreements, and uncontested divorce. Attorney Flaherty also has experience in civil and criminal litigation such as DUI defense.

A Special Master in the Tolland and Hartford Judicial Districts, Attorney Flaherty has also been selected to serve as a Special Master for the Regional Family Trial Docket in Middletown. He has lectured on various family law topics educating young family law attorneys in this field. Attorney Flaherty is admitted to practice in Connecticut and the U.S. District Court for Connecticut, and is a member of the American, Connecticut and Hartford Bar Associations, as well as the American and Connecticut Trial Lawyers Association. He has extensive trial experience in both the family courts and civil courts throughout Connecticut.

Attorney Flaherty received his Bachelor of Arts Degree from Tufts University in 1968 and was in the top 10% of his graduating class at the State University of New York at Buffalo School of Law. He was also selected to serve as a law clerk to the Appellate Session of the Superior Court of the State of Connecticut. Prior to law school, Attorney Flaherty served a six-year term with the United States Navy, where he attained the rank of Lieutenant. Attorney Flaherty served a tour of duty in Vietnam and in the Pentagon as Administrative Assistant to the Chief of Legislative Affairs for the Navy.

An excellent lawyer
Jim was my rock through the divorce process. He was honest with me from the first day about the strength of my complex divorce case and the outcome was exactly what he told me it would be. The other attorneys and paralegals in the office were also very professional and nice to work with. I highly recommend Jim and his firm.

Excellent Divorce Attorney
Jim did an outstanding job handling my divorce. I had interviewed one other attorney yet after my first meeting with Jim, I knew right away he was the perfect choice for me. He was not only honest but very realistic with me regarding expectations and truly helped me navigate one of the most trying times of my life. Jim listened to what I had to say and provided excellent insight based upon his vast experience and knowledge of the divorce process. The time he took listening to my questions and concerns was invaluable, explaining the pros and cons of issues as they arose. Jim and his staff promptly answered my phone messages and emails, never making me feel as though I was imposing or rushed. Excellent attorney!
Attorney Flaherty was instrumental in giving me back my life. He was able to facilitate significant measures through the court system to protect me and my daughter in the course of a difficult divorce, and he provided me with an extensive education about the court system, which I was very grateful for. Being able to understand the legal process of divorce made the entire situation easier to tolerate. My (many) phone calls and emails were always answered very quickly, and with the best information available in that moment. I felt, throughout the divorce process, that Attorney Flaherty was supportive, empathetic, highly experienced and knowledgeable, and wanted nothing more than to protect me in all the ways that I needed to be protected. Hiring him was money well spent, and I highly, highly recommend him.

James is Excellent
James is the top lawyer in the area. He is on the cutting edge of the law, and just as importantly he knows how to apply it. He will aggressively and effectively represent his client through every legal and ethical means available. He can also counsel his client with effective practical advice when necessary. He truly embodies what a divorce lawyer should be. Finally, he provides his services for a very reasonable and fair rate. I would recommend James to anyone looking for top notch representation.

Attorney James Flaherty
Attorney Flaherty handled a complicated divorce. There were many facets to it, such as, custody, business evaluation and asset division. A further complication was the involvement of a prior divorce lawyer. Due to Attorney Flaherty's long term experience in coming across many different types of cases, and his strong financial ability, he was able to navigate through many challenges. I would advise any prospective client to allow him to lead, because he knows divorce law above and beyond what would be considered average. Since he has been around for awhile, he also knows many people, such as top-notch forensic accountants, that can provide required assistance. He is a great listener, and will take your concerns under advisement. If the situation warrants, he has no problem being aggressive.

KIND SUPPORTIVE KNOWLEDGEABLE
WHEN I HAD BEGUN TO LOSE FAITH IN THE LEGAL PROCESS JIM FLAHERTY APPEARED. HIS KNOWLEDGE OF THE LAW, HIS CREATIVITY, HIS PLAIN HARD WORK IMPRESSED ME AND MADE ME A BELIEVER AGAIN. HIS STAFF IS ALWAYS TUNED IN TO EVERY ASPECT OF THE CASE AND ARE AVAILABLE WHEN JIM IS IN COURT. FLAHERTY LEGAL GROUP FELT LIKE A FAMILY. Review for Jim Flaherty
I cannot say enough about how thoroughly satified I am with the services of Atty Jim Flaherty and his entire office staff. The staff is highy competent, empathetic, courteous, professional, personable, and accessible. A phone call or email would always cheerfully be returned promptly, so I was never kept anxiously waiting for a response, or in the dark regarding any issues in my case. I was made to feel like I was a person whose circumstances they truly cared about, rather than just a number or a revenue source. Atty Flaherty was all that his staff was and more. My divorce case lasted almost three years, was extremely complicated, and included a restraining order against my ex-husband for the entire duration, a custody battle requiring my child to have his own lawyer, four court appointed counselors, a bankruptcy filed by my ex-husband during the divorce, and two liens on my home, one from the IRS, both of them on my ex-husband's one-half interest. He coordinated all the interactions of the various lawyers, couselors, depositions, court appearances , etc that were necessary and I was always kept informed. He was never to busy to get back to either through email, or his office or cell phone to update me on the status of my case. His experience , judgement and integrity put the other lawyers to shame. He was never wrong on his predictions as to how he felt an issue would be resolved, on his advise as to what the next action was to pursue, or as to how the settlement would ultimately be resolved. He never talked down to me, and treated me as an equal team player. Before I hired Atty Flaherty, I had another lawyer who had a conflict with another case and could not take my case. It was the best blessing I could have inadvertently gotten. I did not feel this lawyer was truly vested in my case or well-being, felt like I was bothering her and her staff when I called, and never got a prompt response. Dealing with Atty Flaherty and his office staff was a 180 degree turnaround. His demeanor and professionalism make you feel comfortable, at ease and relaxed, at a time which is definitely the most stressful time in your life. I have some friends who are lawyers, and when I needed to find another divorce lawyer I went to them and asked them who they would recommend. Atty Flaherty's name kept coming up as the lawyer most recommended, as they called him "a lawyer's lawyer". After almost three years of dealing with my ex-husband's divorce lawyer, his bankruptcy lawyer, my child's lawyer, the four court appointed counselors , the IRS to resolve the lien on the marital property, and getting the restraining order renewed every 6 months, Atty Flaherty was able to negotiate a very favorable settlement just 12 days before the trial date. I thought for sure we would have to go to trial. I would highly recommend Atty Flaherty to anyone, especially a professional woman, without any reservations. He was well worth the money, and because of his expertise, he saved me hundreds of thousands of dollars . Not only is he a "lawyer's lawyer", he is a people's lawyer.

Not very well informed, quits
Mr. Flaherty advised me totally incorrectly to proceed to court for my ex to be in violation of the divorce decree in regards to cohabitation. He took the case hoping probably to bag $6000 for a morning. He had no idea at all what the legal requirements were in this state for that clause to be enforced. After he decided he had spent enough time on the case, he QUIT. Leaving me to hire another attorney to clean up the mess. A terrible lawyer.

The law surrounding modification of alimony based upon cohabitation is extremely complex. Prior to representing the complaining individual, my partners and I attended two separate seminars on the subject and were fully aware of the complexities in Connecticut General Statute Section 46b-86b which is the controlling statute. The statute requires that in order to justify a modification or termination of alimony, the spouse who is receiving the alimony must be living with another person under circumstances which the court finds should result in the modification, suspension, reduction or termination of alimony because the living arrangements cause such a change of circumstances as to alter the financial needs of that party. Case law also requires a motion for modification under C.G.S. §46b-86b to incorporate the requirements of C.G.S. §46b-86a. The burden on the moving party is to prove the actual cohabitation and to prove that the cohabitation modifies the receiving party’s financial situation. The burden on the moving party as well as the risks of litigation are always fully explained to our clients prior to filing any motion. When the facts of a case change, the array of potential outcomes also change. We at Flaherty Legal Group, LLC take great pride in our knowledge of the law. We work with the family law statutes every day. We attend seminars on a regular basis. We read all of the case law the superior court, appellate court, and supreme court publishes in family cases. Unfortunately, in certain cases such as the one described by the reviewer, facts change. This endeavor was entered into with eyes wide open and full knowledge of the law and of the facts. In the course of the litigation, the facts changed and the reviewer’s willingness to accept certain risks deteriorated. The reviewer’s review is simply untrue.
