I have successfully litigated student loan issues in court up to the First Circuit Court of Appeals. This sparked my interest in advising student loan borrowers regarding their administrative and legal rights.

    13 years, 40 cases

  4. Litigation
    2%
I file consumer cases in NH Bankruptcy Court against credit card and mortgage companies that continue to harass my clients in violation of the bankruptcy code's prohibition against any further contact. I have also sued several mortgage companies under the Truth in Lending Act.

    37 years, 150 cases

I specialize in bankruptcy law and student loan law.  I've been certified as a Consumer Bankruptcy Specialist by the American Board of Certification.  I'm the New Hampshire Chair of the National Association of Consumer Bankruptcy Attorneys.  I have advanced training as a student loan lawyer and have successfully litigated student loan issues in federal trial and appellate courts.

I regularly file chapter 13 bankruptcies in NH to stop foreclosures on a home when a consumer has exhausted other alternatives.  The other typical scenario is where people have suffered a loss of income, a divorce, or serious medical issue that creates financial pressures beyond their control and creditors have refused to work with them.  Bankruptcy can provide a light at the end of the tunnel that permits most people to keep their home, cars, and other assets.

Fraudulent student loan debt resolution
Attorney Richard Gaudreau represented me in federal court and successfully helped me discharge student loans in excess of $150,000 that were fraudulently obtained in my name. Attorney Gaudreau's expertise and professional demeanor kept my hopes high and anxiety low for a successful outcome, which was the case. I was alerted to these loans when the companies involved started sending me letters stating that deferments and extensions had expired and I needed to start paying or they would begin to garnish my wages. Which explains why I had not seen them on my credit reports. The party responsible for this fraud used my signature on two of the loans and an electronic signature on another. The loan companies refused to believe me and as I was the only one they had to cover these loans, despite the fact I was unaware of this identity theft and crime against me, they refused to budge and were beginning the process of wage garnishment.....legally. You can imagine the stress and intimidation when two multi billion corporations have you in their crosshairs. Attorney Gaudreau took my case and led me step by step through the ordeal ultimately resulting in successful litigation in federal court against these loan companies, with the court discharging all fraudulent loan debt, principle and interest in my name. I would never have been able to accomplish this without Attorney Gaudreau. I highly recommend Attorney Gaudreau . I had the absolute right attorney in my corner when I needed one the most. His experience, knowledge, and tireless work ethic saved my financial future. I am forever grateful and relieved.
