Marital Home Agreement
Jan 01, 2015OUTCOME: The children were able to remain in the marital home and each of the parties' interests with regard to the house were met.
Divorce mediation clients of mine had children in high school. Both had an interest in the children staying in the home until college, but thought that their financial settlement would require the i ... mmediate sale of the home. We structured an agreement that gave the parent staying in the home control over most house decisions but also allowed the parent not living in the home to protect his interest in the house's equity. The agreement called for the option for a buyout of the other's interest in the house or the sale of the home a year after the first child entered college.
