If she is on a F2, suggest you change status to F2. Then if her H1 is approved, you can file to change to a H4. If it is denied, her status remains...

Dont let the annulment finalize till Oct 1st. After that you will be on H1 status with the change of status still valid.

I doubt the CIS going to let you stay here for a whole year while you wait for a H1. If you have genuine reason to be here, they might.
I140 approved but shows consular processing .When the priority date becomes current do I have an option to file I 485?

Yes employer can file. If you want to continue working, make sure the H1 gets approved first (file premium), then withdraw the H4.
