Being able to guide a client through a contentious divorce process in an expeditious fashion is one of the keys to being a good divorce attorney. Some cases simply need court intervention while others can and should be negotiated outside of the courtroom. Recognizing the difference is the key to effective representation and achieving the best result for the client.
I am a certified mediator, conciliator, arbitrator and collaborative law attorney in addition to my litigation and appellate practice.
I often advise clients to spend a day in any Probate & Family Court before they make a decision on how to proceed. This usually prompts a discussion of other avenues available to resolve matters aside from going through the court system including a possible appeal, leading to years of expensive litigation.
In my over 25 years as a family law attorney, I am convinced that court should be used as a last resort. Even in the best cases, there is a risk every time you set foot in court and turn the decision-making over to a judge who does not know you or your family. I have become a big proponent of all forms of alternative dispute resolution to resolve client's problems in the first instance. I find my client's have better relations with their children and ex-spouses after a mediated or collaborative settlement. Client's also report that they feel better about themselves and find it easier to move on with their lives. They are also much more likely to resolve new issues that come up after the divorce utilizing the same approach.
