Kurt Kusiak is a partner at Fitch Law Partners in Boston, a graduate of Trinity College (B.A. Honors thesis in economics, 1984) and Boston University School of Law (J.D., magna cum laude, 1991) where he was a member of the Law Review, a Liacos Distinguished Scholar, and winner of the American Jurisprudence Award for excellence in trial advocacy. Following law school, he was a law clerk for the Hon. A David Mazzone, U.S. District Court, District of Massachusetts. Kurt then worked as a trial lawyer for Ropes & Gray and Todd & Weld. Since 2004, Law & Politics has recognized Kurt as a Massachusetts Super Lawyer in its annual list published in Boston Magazine.  Only 5% of the lawyers in Massachusetts are awarded that designation.

 

Kurt has successfully tried numerous cases in the federal and state courts of Massachusetts and New Hampshire and has extensive experience litigating complex business, corporate, and partnership disputes, including those involving breakups, intellectual property rights, freeze outs, breaches of fiduciary duty, misappropriation of trade secrets, and negotiation of employment, non-compete and non-solicitation agreements. He has represented numerous corporate officers and directors in matters involving securities-related claims and investigations by the Securities and Exchange Commission, the Massachusetts Attorney General's Office, and other government entities.

 

He has represented beneficiaries in many trust-related claims against trustees involving breaches of fiduciary duty, negligence and malpractice.

Kurt also has extensive experience representing cities and towns, developers, construction companies, landlords and individual owners in real estate and construction disputes involving easements, adverse possession, eminent domain, commercial and residential leases, and claims by and against subcontractors and architects.

 

In addition, he has taught many Massachusetts Continuing Legal Education Seminars, has been a regular panelist at MCLE's Annual Business Litigation Conference and various seminars at Boston University School of Law, and he is the author of several articles on various business litigation topics published by MCLE as well as the MCLE Massachusetts Superior Court Civil Practice Jury Instructions on Eminent Domain Cases (1998-2003).

Top notch litigator and a pleasure to work with
As trustee of a trust involving a recalcitrant family member, and potentially facing litigation, I hired Kurt to resolve matters which were not progressing to my satisfaction with another law firm. I only wish I had consulted with him from the start. Kurt was a true pleasure to work with. He is highly intelligent, cuts quickly to the core of complex legal issues, is tough when he needs to be, and moves matters forward with decency, sensible solutions and a wry sense of humor. As a fellow lawyer and litigator but without probate experience, I followed every detail of this matter and observed nothing but consistently excellent work on Kurt's part. Our estate matter did not go to court precisely because of his skills in settling it - a settlement which worked to the mutual benefit of everyone. If I ever have another matter requiring litigation or the possibility of it, regardless of the subject matter, I would hire Kurt again in an instant. Settled with a mortgage on the home for breaching hand loan and P&S contract
I approached several attorneys with my complicated long story and every one took at least an hour to understand the case and suggested me useless strategies. I am very lucky to stumble upon Kurt. Finally Settled
When I learned that a company where I was on the Board of Directors did not have D&O insurance (after being told they did) it was upon learning of a lawsuit from a former employee. The lawsuit named the members of the Board in addition to the Company and its owner specifically as having wrongfully terminated his employment and also purchased his ownership position in the company. My search for a firm to defend me independently from the corporation which had mishandled both the D&O insurance and the original suit which we had lost led me to Kurt Kusiak. He was referenced as a Boston attorney who had not only handled cases such as this but had won all that I could find reference to. Despite taking around 3 years to resolve Kurt and his able team, including Hether Cahill, were able to correct prior wrongdoings and win an appeal which completely resolved me from any damages. Since the entire board was named his work also helped the other board members. It was a complex case with records dating back over 10 years but nevertheless Kurt found a way to wade through the many papers and records to prove me clear of any wrongdoing. I would strongly recommend Kurt Kusiak to defend anyone where an action has occurred against the board of directors and/or the individual board members. It was always good to get updates from Kurt because he gave simple English information and outlined the upside and downside clearly. Kurt became my lawyer in April of 2009 and our case was settled in May of 2011.

Trust and Estate Malpractice
We did an exhaustive search to find a lawyer who would solve my family’s complicated trust and estate problems. Most of the attorneys to whom we spoke did not believe the magnitude of the egregious issues involving our trustees, trusts and estate plans. The trustees’ reputations seemed rock-solid to the outside world. Kurt listened to our circumstances. He was instrumental in charting a path to resolution that led to trustee removals and allowed us to optimize the management and financial performance of our trusts and estate plans. Kurt was a breath of fresh air. He gave our family voice and legal standing. He is well grounded, approachable and has a great sense of humor. Kurt did his homework and was creative in the solution to our problem. Most importantly, he educated and navigated my family through the very difficult and emotional process of trustee removal. An amazing lawyer, and even better person!
I worked with Kurt Kusiak on a small ,but tremendously important case for both my family and me. He was compassionate, diplomatic and skilled. You always got the sense he was the nicest guy in the world, but that he would demolish opposing counsel if it was in my best interest. This is a guy you want on your side. I have worked with hundreds of lawyers as part of educational programs, and have worked with several privately, Kurt is a cut above the rest. In addition, to his many skills, he is one of the funniest human beings I have ever met, and is a joy to know.

Great combination of skills
Kurt was our counsel in an adverse posession case and we couldn't have had better representation.
