The driver said that client laughed and ... walked away after the ball hit her car. Client was still playing catch when a state trooper arrived and freely admitted what had occurred. Attorney Leon filed a motion to dismiss the case on the grounds that police did not have probable cause to charge client because there was insufficient evidence to show that he was acting wantonly or intentionally and that the incident was an accident. There was also no allegation that it was client who threw the football when it caused the damage as opposed to his friend. On the day of the hearing on the motion to dismiss, the prosecutor agreed that the police lacked probable cause and the case was dismissed.
