Client was facing a mandatory minimum sentence of 2½ years in state prison due to his prior conviction for carrying a dangerous weapon (sawed-off shotgun) 15 years earlier. Attorney Leon filed a motion to suppress the stop of the car and subsequent search. The motion was allowed after an evidentiary hearing and all evidence illegally seized by police was thrown out and the case was dismissed.

Attorney Leon’s investigator obtained video from the bottom of the stairwell which proved that neither woman fell down the stairs. Attorney Leon scheduled the case for trial and provided the prosecutor with the video. On the day of trial, the prosecutor explained that the two women would not be appearing for trial after being made aware that there was video of the incident. The case was then dismissed.

Client was charged with Assault and Battery on a Police Officer after he allegedly spit on a police officer. Client was a courier and was almost hit by the officer’s cruiser when it veered into the adj ... acent lane of travel. In response, client spat at him. On the morning of trial, Attorney Leon explained his defense to the prosecutor and argued that they would be unable to prove intent at trial. The client was positioned right next to the officer’s window and spat on the car; however, some of his spit ricocheted off the door and onto the officer. At most they could prove vandalism which wasn’t charged. Attorney Leon persuaded the prosecutor to agree to a short term of pretrial probation. The case was then dismissed 6 months later without any admission of wrongdoing by client.

Police saw the torn corner of a plastic sandwich bag that was consistent with heroin packaging in his lap. A state trooper shook him awake and client woke up in a daze. Client initially said he was sleeping but then admitted that he shot up “a third of an eight ball” down the street and was waiting to get into a program for his heroin problem. Police had him exit the car and he was unsteady on his feet and had very little balance. Police then searched the car and found a spoon in the center console with a hypodermic needle and syringe. Client had trouble staying awake when he was sitting on the curb waiting for an ambulance. Attorney Leon filed a motion to suppress the client’s statements to police on the grounds that they were not voluntarily made. The motion was denied by a judge; however, at the hearing on the motion, Attorney Leon cross-examined the arresting trooper and he testified inconsistently about significant aspects of his report and appeared to perjure himself when discussing his actions on-scene. Attorney Leon obtained a transcript of the motion hearing and provided it to the prosecutor and highlighted the trooper’s credibility issues from the hearing. On the morning of trial, the prosecutor filed a motion to dismiss the case and told the judge that there was insufficient evidence to go forward and could not sustain their burden of proof. The case was then dismissed.

Attorney Leon’s investigator spoke to the front desk attendant who explained that the man who accused client arrived and waited in the lobby for over an hour while repeatedly calling his ex-girlfriend who lived in the building. The attendant saw client come downstairs with the woman and begin arguing with the man. This escalated to a physical altercation during which client overpowered the man and police arrived shortly after. Attorney Leon investigated the alleged victim’s past and found that he had a lengthy history of violence and sex offenses. He provided this information to the prosecutor and prepared the case for trial. On the morning of trial, the prosecutor explained that the alleged victim wanted to drop the charges after he was made aware that the defense would be using his prior history to argue that he was the first aggressor and that client was simply defending himself and the man’s ex-girlfriend. The case was dismissed.
OUTCOME: No Violation Found; Probation Continued
Client in the case above was also on probation for Assault and Battery with a Dangerous Weapon, Assault and Battery, Malicious Destruction of Property and Threats at the time he was charged in the new ... case. He was issued a violation notice by the probation department as a result of the charges and held without bail. Attorney Leon prepared for the probation surrender hearing and persuaded a judge that no violation of probation should be found because client was acting in lawful self-defense. Attorney Leon presented the testimony of the front desk clerk at the apartment building as well as the police reports and court records of the alleged victim. The judge agreed that client did not commit a crime and continued his probation until the original termination date.
