Client was charged with Assault with a Dangerous Weapon after police saw him swing a knife at another man during a fight. This witness saw the other man pick up a knife from the street and chase client until they started fighting each other. Police only saw the end of the altercation and didn’t see that client was acting in lawful self-defense. Attorney Leon was able to persuade a judge to dismiss the case.

He convinced the prosecutor and judge to agree to dismiss the case on $100 in court costs and forfeiture of the weapon. The case was dismissed.

Attorney Leon’s investigation revealed that the woman who was ... slashed was the instigator of the fight and assaulted the client as soon as client opened the front door of her home. His investigation produced a witness who observed the altercation and would testify at trial that the client was acting in self-defense after she was attacked. On the morning of trial, the alleged victim invoked her Fifth Amendment privilege not to incriminate herself and the case was dismissed.

Client was charged with OUI-Liquor and Negligent Operation of a Motor Vehicle after driving into a parked car in front of a state police barracks. Troopers arrived to find his car with heavy front-end ... damage and another car completely up on the sidewalk from the impact. The owner of the parked car had just gotten out with her husband before the crash. Client told police that he didn’t know what happened and was coming from his friend’s house. Troopers spoke with a witness who said that client’s car was speeding before it struck the parked car and pushed it up onto the sidewalk. Client was unsteady on his feet, had slurred speech, and was unable to recite the alphabet. He was taken to the hospital because of a head injury. Attorney Leon filed a motion to dismiss the OUI Liquor charge because there was no evidence in the police report that alcohol was involved because it did not contain an allegation of an odor of alcohol coming from client or any alcohol found in the car. The prosecution responded by filing a motion seeking a court order for client’s medical records to obtain his blood alcohol content to show that client was intoxicated. On the day of the hearing on the motions, Attorney Leon persuaded the judge to dismiss the OUI Liquor charge and allow client to resolve the remaining negligent driving charge with a continuance without a finding for 15 months. The prosecutor was seeking a 2-year jail sentence with 60 days to serve and the balance suspended for 2 years of probation with conditions that client not drink alcohol and submit to random alcohol testing. As a result, client had the OUI charge dismissed, avoided a conviction on the negligent driving charge, and the case was dismissed after 15 months.

Client, a high school student, was charged with Larceny Over $250 after he was accused of stealing an iPod from a classmate. She reported it stolen in September 2012 but told the police that it was st ... olen around May 2012. She claimed a third party told her that client had stolen it. She said she saw a picture of client with what she believed was her iPod. She claimed that she tried to speak to him about it but he was evasive and hung up the phone on her. She then claimed that he had called her up and confessed. On the trial date, Attorney Leon persuaded the prosecutor and the judge to dismiss the case because the only evidence against his client was inadmissible hearsay that a third party had told the alleged victim. The case was dismissed.

He was willing to pay restitution and plead guilty if the prosecutor reduced the felony charge to a misdemeanor; however, the prosecutor was seeking a felony conviction and 6 months of probation in exchange for a guilty plea. This was unacceptable to client and the case was set for trial. On the morning of trial, Attorney Leon persuaded a judge to dismiss the case because the prosecutor had failed to provide the video evidence they claimed to have as well as any business records to support the allegations. The case was dismissed.
