Client was charged with Open and Gross Lewdness after he was accused of exposing himself to a woman. She called police and they found two men on the stairs inside of a building. The woman identified ... client when he was brought out by police. Attorney Leon investigated the case and obtained video showing that client was simply urinating against a wall and that the woman could not have seen his genitals from the location where she was standing. He provided the video to the prosecutor and on the morning of trial, the prosecutor asked for the case to be dismissed because the alleged victim admitted that she never saw client’s genitals when presented with the video. The case was dismissed.

Breaking and Entering at Night with the Intent to Commit a Felony and Assault and Battery

Client was charged with Breaking and Entering at Night with Intent to Commit a Felony and Assault and Battery after she was accused of breaking into a woman’s home with three other women and assaulting ... her at night. The alleged victim told police that she opened her door and client began punching her in the face. Then the women went downstairs and stole several items from the home. Attorney Leon investigated the case and learned that the alleged victim was the girlfriend of client’s brother. She had called police earlier in the night to have him arrested for domestic violence. Client received a call from her brother asking her to pick up some of his belongings from the home and she went over with her mother. The alleged victim let them in and they argued for a bit as client was gathering her brother’s belongings. It ended in a screaming match between them but they did not touch one another. The alleged victim called police after they left and falsely claimed they had forced their way in and attacked her. This information was presented to the prosecutor and judge who then dismissed the case.

Attorney Leon persuaded a judge to dismiss the case because the prosecutor failed to turn over the court-ordered discovery. The case was dismissed over the prosecutor’s objection.

Client was charged with Operating with a Revoked License as a Habitual Traffic Offender and faced up to 2 years in jail because of the habitual traffic offender enhancement. The prosecutor was seeking ... a jail sentence of 60 days in exchange for pleading guilty. Attorney Leon filed discovery motions with the court for the underlying RMV records and set the case for trial. On the day of trial, the prosecutor had the state trooper and a witness from the RMV present with the certifications showing that client’s license was revoked at the time he was pulled over. Attorney Leon persuaded a judge to dismiss the case because the prosecutor failed to obtain the court-ordered RMV records showing the basis for client’s adjudication as a habitual traffic offender. The case was dismissed over the prosecutor’s objection.

They were hanging out at her apartment and she accused client after she realized the money was missing from ... her purse. Attorney Leon investigated the case and discovered that they had been using drugs along with a few other people who were present. The investigation revealed that the alleged victim did not know who stole her money and simply assumed it was client. Attorney Leon was able to get the case dismissed.

He claimed that client showed up at his workplace and he had to flee the area because she wa ... s so verbally abusive. Two days later she called his phone over 50 times and showed up at his workplace again. He walked to the police station and she followed him inside. She then fled when an officer saw her. Attorney Leon investigated the case and discovered that client’s ex-boyfriend had a lengthy criminal history and a serious alcohol problem. He did not show up for the trial; however, the officer who saw client was present. Attorney Leon spoke to the officer with the prosecutor and he admitted that he only saw client and her ex arguing outside of the police station and never saw her inside the station. Attorney Leon argued that the prosecutor could not go forward with the trial because the officer had admitted that what he wrote in his report was incorrect. Attorney Leon persuaded a judge to dismiss the case.

Client charged with Domestic Assault and Battery after his ex-wife accused him of choking her and hitting her during an argument. Police arrived and noticed that her head was swollen. Pretrial investig ... ation revealed that they’d been involved in a contentious divorce and client had been awarded full custody of the children. At trial, Attorney Leon successfully argued that client’s ex-wife fabricated the attack in an attempt to gain an advantage in their ongoing child custody dispute. Client’s ex-wife testified that client struck her in the face and choked her and the prosecution also presented hospital records and a nurse who noted bruising and swelling on her head. Client was found Not Guilty after trial.

A state trooper pulled him over and smelled a strong odor of alcohol on his breath an ... d his eyes were red and glassy. Client’s speech was slurred and he admitted to drinking all day at the beach after police found a liquor bottle that was almost empty. He then failed several field sobriety tests, including the walk-and-turn test and the one-leg stand. Today, Attorney Leon persuaded a judge to allow his motion to dismiss the case over the prosecutor’s objection.
