Sometime back I wrote a reference for, or a testimonial if you will, of Attorney Heffernan's representation as our legal counsel. A couple years have passed since that legal matter/litigation was concluded. With time and distance comes a calm of emotions, insightful reflection, and a more astute pers...pective. With that in mind I add these words to my original reference. [Looking back I'm embarrassed at what a pain I probably was as a client. I'm still astonished at how much the legal system diverges from the black and white letter of law and a layman's perceived belief of legal procedure. I'm still surprised, perhaps 'appalled' is a better word, at how much factual misrepresentation can be submitted before the bench in legal proceedings. You need very competent counsel to navigate the murky gray waters before you. That being said, two things left the greatest impression on me about Attorney Heffernan's representation: The first, the ever present calm he continually demonstrated despite everything from over emotional clients, gratuitous antics of opposing counsel, and the occasional baffling court ruling; The second, his knowledge about the practical application of law within the legal system. Maybe most impressive of all was that Attorney Heffernan did just what he told us he would do and got the outcome he believed would be the end result. I'm not saying he made promises or gave guarantees. He did not. What he did do was make a calculation based on experience, the issues of our case and his knowledge of how he anticipated the court would likely apply the law in our matter. I can't emphasize the importance of those last words enough - understanding and anticipating how the court would likely apply the law in a matter. That's what you will get with Attorney Heffernan as your counsel. In the end all I ever needed to do was just stay calm, stay the course, and trust him to represent my interests to the best possible outcome. Respectfully, that's just what you should do also.] Original: Despite the plethora of Attorneys in our litigious society finding an attorney as professional, ethical and competent as Attorney Heffernan is not a given. Finding an attorney that understands the nuances of the legal system and the practical application of the law as well as he does is rare. Most of us won't realize the cost of not having these attributes in his/her legal counsel until it’s too late. Ultimately what most of us care about is whether an attorney gives us a better than average chance of ‘prevailing’ in our litigation. In the world of litigation prevailing is rarely as simple as win it all, or lose it all. Based on my experience Attorney Heffernan will tell you the way it is, not mindlessly acknowledge the declarations or rantings of what you want things to be. He will educate and inform, research and consult, guide and advise, zealously mediate and urge all parties towards a fair resolution. Then, if necessary, undertake every reasonable legal avenue to advocate for your best interests. He is timely and responsive. He will be prepared. He will not waste your money in legal fees playing games as many attorneys do, or waste the court's time with frivolous filings. He always advocates taking the high road and maintains integrity at all times. Looking back I find myself admiring the balancing act Attorney Heffernan professionally managed within our case; comprehension of complex and involved issues, extraordinary patience with high maintenance and demanding clients, and managing opposing counsel who were often unnecessarily aggressive and antagonistic in their conduct. He took it all in stride, never lowering himself to opposing counsel’s level, always prepared, respectful, and professional before the bench.
