My practice focuses on general civil litigation. I have represented Fortune 500 companies, private companies of all sizes, large insurance companies, and major Massachusetts law firms in a wide variety of litigation matters. Over the years I have gained a broad base of experience representing various professionals, businesses, and individuals.
I have been involved in numerous types of business litigation, including but not limited to, shareholder disputes, business torts, contract disputes, and employment matters. I have litigated intellectual property matters including the enforcement of trademarks, protection of trade secrets, and patent infringement claims. I am a registered patent attorney.
In the area of professional liability, I have defended law firms and individual lawyers, including significant experience defending specialized practitioners such as patent lawyers. I have also defended real estate brokers, securities brokers, registered investment advisors, insurance brokers, architects, engineers and psychologists.
I also incorporate my experience as a licensed private pilot in the representation of aircraft owners and pilots in Federal Aviation Administration Enforcement actions. I am an active member of the Aircraft Owners and Pilots Association panel counsel. I have represented aircraft owners, fixed base operators, repair facilities, pilots, flight instructors and aviation insurers in numerous civil cases. I currently act as New England regional counsel to British Airways and Alitalia Airlines for the defense of civil actions filed against the airlines in the New England region.
In addition to the above, I also enjoy a challenging insurance defense practice in the defense of insurers and their insureds in a myriad of general liability, environmental, and toxic tort cases including extensive experience in the defense of personal injury and property damage cases. I have had the pleasure of representing retailers, distributors, and product manufacturers in a number of cases alleging breach of warranty and negligent design and manufacture.
I have tried high exposure cases to verdict in state and federal court in Massachusetts and Rhode Island and in federal court in the state New York. I have also litigated in state courts in Ohio, New Hampshire, and Maine. Representative cases include:

No. 99-4617) (successful trial to verdict representing Ford Motor Credit Company in catastrophic personal injury case with multi-million dollar exposure prosecuted under the now repealed vicarious liability laws of Rhode Island which imposed potentially unlimited liability on Ford Credit).
Reliant Airlines, Inc. et al v. County of Broome (United States District Court for the Northern District of New York C.A. No. 90-CV-537) (Successful prosecution of claims asserted by Reliant Airlines to recover seven figure judgment for property damage to Falcon 20 aircraft destroyed in runway overrun due to untreated ice on runway and incorrectly reported braking action advisories).
Play Time, Inc. v. LDDS Communications, Inc. and Michael Eisemann (United States District Court for the District of Massachusetts C.A. No. 96-2066) (Successful trial to verdict representing individual who retained ownership rights to unique and commercially valuable 800 telephone number).
Richard Williams v. Richard Bihrle et al (Dukes County Superior Court C.A. Nos. 94-0081 cons. 95-0003) (Successful trial to verdict of equipment retailer in product liability case involving a chainsaw sold by client to plaintiff who severed his arm while using the product).

Kevin was working on a condo issue with us. His initial response was slow to start followed by 3 letters to our condo associate, followed by a $2500 bill and then nothing. After paying we never heard from Kevin again. He will waste your time and your money - don't bother.
I am surprised and personally disappointed by this review as it does not accurately reflect the nature or scope of my representation. I am also disappointed insofar as the clients failed to follow the dispute resolution process set forth in the engagement letter which they both signed. The reviewer and his partner, co-owners of a condominium unit in a two unit condominium building, retained me to assist them with resolving a number of issues they had with the owner of the second unit. Both clients seemed to be very nice people. They signed a retainer agreement on or about July 1, 2015. I was provided with portions of the condominium documents to review. I carefully reviewed the title available online and downloaded full copies of the relevant documents from the registry of deeds website. I reviewed and analyzed the relevant documents consisting of approximately 50 pages of the master deed, trust, and bylaws. I also reviewed the relevant statutory provisions and recent case law regarding resolution of deadlocks and enforcement of condominium rules and bylaws. I then had several email exchanges and phone calls with the clients and outlined a course of action.. On or about July 15, 2015 I sent the clients a draft version of a three page demand letter for their review and comments. That letter, ultimately sent to the other unit owner, provided the other unit with an analysis of the condominium documents and the alleged violations. With the clients edits included, the initial demand letter was sent to the other condominium owner on July 24, 2015. A subsequent four page demand letter and notice of annual meeting was sent on August 13, 2015 and instructions were sent to the clients regarding what to do if the other unit owner failed to appear for the meeting. Notices were sent to the other unit owner and I communicated multiple times with the other unit owner in an effort to initiate meaningful settlement discussions. I recorded each of the individual tasks I performed which were itemized on the bill. Pursuant to the terms of the engagement letter, if the client had any issues with the bill the clients had the right to initiate a dispute resolution process, including arbitration. The clients never complained to me about the amount of the bill or any of the time entries until this review was published almost a year after the representation ended. Nether client initiated the dispute resolution process or even called me to complain about any aspect of my representation. Initially both clients were fully engaged and each was involved in choosing between various alternative strategies which might lead to a resolution of the underlying dispute. The clients' numerous emails to me throughout the process confirmed that they received timely status reports and that they assented to each step taken in an effort to amicably resolve the dispute. The clients refused to authorize me to initiate litigation. Each client was provided with my email, direct line number and personal cell phone number. My efforts to initiate meaningful settlement negotiations with the other unit owner were thwarted by the other unit owner's unwillingness to participate in the process. I thoroughly discussed the litigation option with the clients and provided them with a realistic budget. The clients elected not to authorize me to pursue litigation. Therefore, my engagement was at an end unless and until the clients directed me to move forward with the filing of an equity action to enforce the terms of the condominium master deed, trust, and bylaws. Despite this review I have reiterated in writing to both clients that I am willing to pursue litigation on their behalf. The clients have failed to respond.
