  • Golf Cart Accident Caused by Drunk Driver

    Practice Area:
    Personal Injury
    Date:
    Jun 02, 2010
    Outcome:
    $215,000 settlement
    Description:
Brett & Coats represented a client who was a professional baseball player in the early stages of his career. He was traveling with the team in Washington State, and several teammates went to a local pub after a game. After having a few drinks, the teammates began walking back to their hotel. During the walk, the group saw an unoccupied golf cart with the keys in the ignition. Poor judgment compelled them to take the golf cart. Our client was the passenger and one of his teammates drove the cart. Ultimately, the cart left the sidewalk and crashed into a fire hydrant, severely fracturing our client’s right ankle. Two surgeries and extensive physical therapy were required for him to heal. His future as a professional baseball player was in jeopardy. Attorney David Brown had a real challenge in front of him, since the driver’s insurance company denied Liability and Personal Injury Protection (PIP) coverage of the golf cart. The at fault driver’s insurance company argued that the policy did not cover injuries sustained in accidents involving golf carts. Through extensive negotiation, David Brown was able to convince the insurance company that the golf cart was indeed eligible for coverage under Kansas State insurance law, and the case was resolved for $215,000.
  • $182,500 for serious back strain causing long term disability

    Practice Area:
    Personal Injury
    Date:
    Apr 27, 2011
    Outcome:
    $182,500 for plaintiff
    Description:
Our client Chris contacted Brett & Coats needing help after being involved in two moderate impact car accidents. Since Chris didn’t recognize at first the extent of his injuries, he failed to acquire immediate medical care. His doctor diagnosed him with serious cervical and lumbar strains. These “whiplash” type injuries are usually resolved quickly, but Chris’s physical condition continued to deteriorate. As a result, his injuries prevented him from returning to his job as a welder. His inability to return to work resulted in a significant wage loss claim, atypical in a soft-tissue “whiplash” type case. In the beginning, the two insurance companies for the defendants disputed that Chris was experiencing a disability. After lengthy negotiations and intensive documentation of Chris’ injuries and claim by Brett & Coats attorney David Brown, the insurance companies backed down and ultimately agreed to settle Chris’s claim for a total of $182,500.
