Description: Young man who had just received his driver's license was involved in a terrible accident in which another young man was killed. The State charged that the accused was racing his friend at the time of the accident which proximately caused the other young man's death. The defense successfully argued to the court at trial that there was no racing on the part of the accused, and his driving was not the proximate cause of the other young man's death. The judge found the young man not guilty.
