The lack of healthcare or appropriate healthcare for your husband is the most immediate concern. There is nothing to prevent you from speaking with the other driver directly. Since you do not have collision coverage on your vehicle, you only have a few options. You can settle for the $5k GEICO policy limits; you can take the $5k from GEICO and try to negotiate with the at-fault driver for the remaining balance; or you can sue the other driver for the full amount and go after the driver's assets for anything you get in excess of the GEICO policy.
