Description: Plaintiff was a partner in a real estate investment. Just before the close of escrow on the sale of the property, a dispute arose between the partners and the plaintiff became concerned that he would not recieve his fair share of the sale proceeds. We immediately filed a complaint with lis pendens (to tie up the property pending resolution of the case) and sought an ex parte (emergency) restraining order. As a result, the parties negotiated a resolution of this matter and escrow closed. As a side benefit, we were also able to successfully resolve a separate business dispute involving some of the same defendants.
