  • Will an arest show up on my fingerprinting? And my fingerprinting was delayed how long could that take?

I was interviewed for a job got the job offer a week later and then I was arrested for a dui, I have not yet been convicted and working on getting an attorney to help. Before the interview it only asked if I have ever been convicted of a misdemean...

    John’s Answer

The arrest will show up on the DOJ's livescan although your employer cannot access that directly. It could be picked up by companies that do background checks. True you haven't been convicted yet but in general an employer may ask about convictions and pending cases. You have a pending case which may interfere with your employment since your DL will be suspended for a year for underage drinking.

Your bf may well be innocent but I doubt his PO acted on mere allegations. There is probably more to this than you know or he is willing to tell you.

  • Criminal Record Expungement

I've been working professionally for near 17 years. I was offered a pretty lucrative position a few weeks ago, but there's a holdup. They had me go through FBI and Child Abuse clearances. My child abuse clearance came back clean. My FBI fingerprin...

    John’s Answer

If your conviction was in federal court no statute creating a generally available federal expungement remedy exists, and numerous Courts of Appeals have adopted the view that there is no judicial authority to expunge federal criminal records absent specific legislation or extremely rare and extraordinary circumstances. If it was in state court you need to contact a PA lawyer to discover what remedies exist in your state.

  • I got put on in the judge then I violated my probation so I'm wondering if I'm going to jail

I was put on probation in 2014 for the petty theft I have not gotten in trouble since until 2 months ago when I broke a window on accident but the judge said I violated I just need to know what is more than likely to happen when I go to court I am...

    John’s Answer

Following up on my colleague's advice I have one comment. Most of my clients say they can't go to jail. All of them are wrong. The court does not really care about your family situation and, if it deems the punishment appropriate, will definitely put you in jail. That said your VOP seems minor (accepting what you say as true) and I doubt the judge will choose the nuclear option. Best consult with your attorney.

  • I am not sure what kind of attorney I need. I am being investigated by the FBI and have not been charged with anything yet.

I need to know what kind of attorney will be able to help me. It comes from filing a workman's comp case and the company looking for a reason to fire me. They came to me while on disability in 11/2014 and said that in 2012 I broke an ethics code a...

What makes you think the FBI is interested in a welfare fraud case? No matter really you still need to hire a criminal defense attorney.

  • I accidentally missed my traffic school deadline and haven't paid yet either, what can I do?

I was travelling last month and had my dates for when this was all due mixed up- I was supposed to pay a reduced fine of $121 and $52 admin fee and complete traffic school by Jul 06. I'd fallen behind on paperwork and lost the documents with the d...

    John’s Answer

You were due to complete by 7/6 but hoping you had until August? Thats not much of a excuse regarding a $238 ticket. You could put yourself on calendar and ask for an extension. You could also hire an attorney to work this out for you. There is a traffic clinic right across the street from the courthouse on Bryant. I understand their fees are reasonable.

  • Homeless Woman in Children's Park Sleeps There All Day Every Day

There is a homeless woman who sleeps all day in the park near my house. There are no other homeless people and lots of children at this park. The homeless woman doesn't seem to bother anyone, she just sleeps there all day. I see her walking up the...

    John’s Answer

What on earth do you have against a homeless person who sleeps in a public park? They have to be somewhere, don't they? You have stated there are no other homeless people there so you can't claim nuisance and you don't blame the needles on her. People with you attitudes are going to wake up one day but it will be too late.
