You can make a motion for an award of attorneys fees after the trial court has ruled in your favor and before the appeal, or you can wait until the appeal is decided. From a strategic perspective it is preferable to seek a fee award once you win at the trial court level. A fee order puts your opponent on notice that he or she owes you the amount awarded.
