What are my legal rights ?

Asked by a user in Van Nuys, CA - 13 days ago.

I'm sorry to hear about the problems you are having. You may very well have legal rights, but I'm going to need more information. You say you were given "a warranty" but then you talk about fhe "warranty company". That makes it sound more like what you got was a service contract. Unfortunately, that does not give hou the same rights. You should have an attorney review all your papers and give you an opinion on that. If the problem is serious enough and happened soon enough you might also...

Can a return a car for a refund to a private seller?

Asked by a user in Fair Oaks, CA - 3 months ago.

I'm sorry to hear about the problems you are having. I agree with the other attorneys that you have a right to have the sale cancelled because of the misrepresentations and the lack of a smog certificate (assuming the seller didn't just forget to give it to you). I would recommend that you get something in writing showing the problems, like an estimate from a mechanic and from the body shop. I would then take that to the seller and tell him that you want to give him back the car and get your...

I bought a guitar online as "new" after a year of problems, it was found to be factory "second" How can I persue correction?

Asked by a user in Hawthorne, CA - 10 months ago.

I'm sorry to hear about the problems you are having. I am a guitarist myself, so I know how important it is to get what you want in an instrument. California's "Lemon Law' applies to any consumer good, including a guitar, that is purchased in California. I believe that this sale would be construed as falling within that requirement. In addition, the Consumer Legal Remedies Act covers sales where the product is not as it was represented to be. Both of these laws give you the right to sue,...

Can I sue someone who sold me a vehicle off a Craigslist ad?

Asked by a user in Sacramento, CA - 20 days ago.

I'm sorry to hear about the problems you are having. I agree with Ron and with Scott that you are protected by the law and are entitled to take these people to small claims court. Make sure you have the written contract and the report from the smog testing place to take to court. The small claims court will have instructions that you can get that will explain the process to you, and the state has a website with more instructions: http://www.courts.ca.gov/selfhelp-smallclaims.htm Feel free...

If i bought a unknown salvage title vehicle, but the registration was in the car; can i still sue him and get my money back?

Asked by a user in Northridge, CA - 21 days ago.

I'm sorry to hear about the problems you are having. If the seller didn't tell you about the salvage title, that's fraud and you can make him give your money back.

Tranny blows, hour after private sale. seller agrees to give back 600$ towards repairs, now won't answer/ return calls. what can

Asked by a user in Pinole, CA - 4 months ago.

I'm sorry to hear about the problems you are having; I know how frustrating this must be for you. The first question I have is--has your check cleared? If not, ask your bank to put a stop payment on it. Next, you should have a mechanic give you a written report saying exactly what is wrong with the car and what it will take to repair it. Next, write a letter to the seller, with a copy of that report, telling him that you will sue him if he does not give take the car back and give you your...

What can i do cars not fix so cant get keys from mechanic? what do i do seller states they will call CHP to tow it for abandmn?

Asked by a user in Sacramento, CA - 1 day ago.

I'm sorry to hear about the problems you are having. You have the right to make the seller of this car give you your money back. I can't tell from what you have said whether this is a private seller or a dealer. That makes a difference in how likely it is that you will be able to make him do what he is supposed to do. Most dealers are going to be more likely to be cooperative. The problem with the mechanic is less clear. You call him "there mechanic", so it sounds like he works for the...

Do I need a lawyer

Asked by a user in Moreno Valley, CA - 21 days ago.

I'm sorry to hear about the problems you are having. You may be able to force them to fix your car if 1. They gave you a warranty, 2. The problems are so serious that you can't safely drive the car. 3. The problems are so obvious that the seller must have known about them and concealed them from you. If the contract says "as is" that makes it harder for you to prove a case. Please feel free to visit my website and read my blog for more information. Best of luck.

I bought a car and the next day the fan blew up what do i do

Asked by a user in Banning, CA - 27 days ago.

I'm sorry to hear about the problems you are having. In California, you have some very strong protections under the law, and there is a very good chance that a lawyer specializing in Lemon Law cases can make the dealer give you back your money. I strongly recommend that you contact a lawyer and get his or her advice. Make sure they specialize in Lemon Law cases. Most of them will not charge you anything for a consultation. Best of luck! Please feel free to visit my website and blog for...

I bought a ford that doesn't have all options promised

Asked by a user in Roseville, CA - 2 months ago.

I'm sorry to hear about the problems you are having. I agree with my colleagues, you have remedies under California law. If you are not able to resolve the matter directly with the dealer, I recommend you contact Attorney Kaufman, who is highly experienced in these matters. In fact, it would probably be worthwhile consulting with him in any event to get his advice, so that the dealer does not take advantage of you. Feel free to check my website and blog for more information. Best of...
