    My clients agreed to sell a large parcel of land to the plaintiff for a below-market price on the condition of a 30 day escrow. Buyer/plaintiff could not find financing for almost 12 months. My clients finally cancelled the sale. The defendant sued them for specific performance, attorney fees and costs. The arbitrator, a retired judge, found that my clients were justified in cancelling the sale when the buyer couldn't perform.

    My clients' kitchen appliance caught fire spontaneously, destroying most of their kitchen and causing water and smoke damage throughout their house. They were forced to live elsewhere for three months while their home was repaired. On behalf of my clients I sued the product manufacturer. The defendant removed the case to federal court and moved for dismissal of the emotional distress damages. I successfully defeated their motion, and we reached a favorable settlement at the Early Neutral Evaluation.

We sued the seller for non-disclosure, their broker for breach of fiduciary responsibility, and a repair contractor for negligence. We have reached favorable settlements with all defendants except their real estate agent and broker. The case will go to trial in March, 2009.
