    It sounds like you may want to jump ship and get a new attorney. Communication is the key to getti g good results in thesetypes of cases. You can switch attorneys at anytime. The prior lawyer can only assert a lien against your accident case not your ssn. When you hire a new lawyer they will be able to take care of this.

    Within this context lost wages occur when you miss work because of your injuries. If you were not injured as a result of the accident them you would not have a lost wages claim and the insurance company would be right.

    What you could do is get a loss of use claim because you did not have your car or a rental for two weeks. While this probably wont come close to making up for your wages it is better than nothing.

    I would contact a Riverside attorney through avvo. This is a complex case with a lot of different moving parts. The good thing about hiring an attorney is that you dont have to worry about it and you can focus on the kids and everyone's recovery.

    I think taking the driver is a good option as Christian said in the previous answer. If you choise this route, make sure you communicate with your insurance company. A lot of times in situations like this they place 50% liability on each side. Good luck!

    If you are involved in an auto accident that is not your fault and you are injured you are still entitled to compensation. However, in California the law will prohibit the recovery for pain and suffering if you do not have valid insurance. In the situation you described it sounds like that may be the case. I would contact a personal injury lawyer to discuss. Sometimes you can find coverage through other family members if they live together in the same household. They are also ways around the bar to pain and suffering damages.

    This is a tough situation to be in. In California, statistics show that 1 out of every 4 drivers do not have valid insurance. I think your best option would be to file a small claims action against the owner of the vehicle. You may have difficulty serving her so you might have to contact a process server to help you. It may take some time and investigation on your part but it is worth the fight. Good Luck!

    I would advise that you at least speak with an attorney regarding the accident. Typically when you are rear ended it is not your fault. There are some very rare situations where someone can attempt to place liability on you even when they rear ended you. Most personal injury and auto accident attorneys offer a free consultation. Also, if the person who hit you is claiming damages your insurance company will defend you. I would still advise that you contact a car accident lawyer to get some further advice.

    This situation can be very common. I understand that you want to get your net proceeds as quickly as possible. However, it sounds like your attorney is attempting to negotiate down your medical payments with Geico. If this is the case, he is doing his best to maximize what you get in your pocket. This is a good thing for you. Many lawyers just take their fee and don't do the little things to maximize what their clients receive as net proceeds. I would suggest that you contact your attorney and have him explain better as to why you are waiting. In regards to getting your attorneys fees reduced, I would discuss this with your attorney. Contingency fee agreements are a contract and attorneys usually don't reduce their fees. Especially if he is doing more work. Good Luck.

    Sorry to hear about your accident. There is an important distinction you need to explain. Did the officer actually see the accident? If he did not witness the accident and just drafted his report off of statements taken then you may have a case.

    I handle all personal injury and auto accident cases and I have had many cases where the traffic collision report placed my clients at fault even though they were not. This is because the officers usually take statements from everyone and then draft the report based on the statements. While they are usually pretty accurate, they do make mistakes from time to time.

    Many times the insurance companies make arbitrary decisions as to liability on an accident. If you are not going to pursue any claims for personal injury, you still may have a claim for the property damage. It appears from your inquiry that the other sides insurance company did not fully compensate you for the damage to your vehicle. If you think that you are not at fault for the accident and you have not signed a settlement release agreement with the other side, you may have a claim against them. You may want to contact a property damage attorney to discuss your claim. Alternatively, you could also pursue the action in small claims court. In California, you can recover up to $10,000 for a property damage claim. If you or anyone in the car have suffered any types of injuries you should seek a personal injury attorney in your area.
