A power of attorney allows you to designate an agent to act on your behalf in all situations. The agent has extensive powers to contact the IRS, social security, and pension administrators--assets which affect you, but are outside of your living trust. It is recommended that you and your husband prepare powers of attorney in addition to your living trust.

A power of attorney dies with the individual. You need to execute a will to set forth your final wishes.
